If you normally live in Australia and are applying for compassionate release to fund medical treatment overseas, the supporting Australian medical practitioner may need to explain why the treatment cannot be provided in Australia.
That means choosing an overseas rehab because you prefer the location or because the programme appears less expensive does not, by itself, establish eligibility.
The medical evidence still needs to support the proposed treatment and satisfy the ATO’s current requirements.

Can You Access Super to Pay for Someone Else’s Rehab?
Potentially.
Compassionate release can apply to eligible medical treatment for you or your dependant.
That does not mean you can automatically use your Super to fund treatment for any family member.
The person needs to meet the relevant definition of a dependant, and evidence may be required to establish that relationship or dependency.
This can become particularly relevant where a parent, partner or other family member is trying to find a way to fund treatment for someone they love.
If this is your situation, establish whether the person would qualify as your dependant before assuming your Super can be used for their treatment.
How Much Super Can You Access on Compassionate Grounds?
There is no universal amount that everybody can withdraw.
The amount released on compassionate grounds is connected to the eligible expense the ATO approves and the amount available within your Super.
This is different from older early-release schemes that allowed some Australians to withdraw fixed amounts such as $10,000.
If treatment costs a particular amount, your application needs to be supported by the relevant treatment quote and other required evidence.
It is also worth remembering that tax may affect the amount you ultimately receive, so the figure approved for release and the amount available to pay an expense may not always be identical.
How Long Does Compassionate Release of Super Take?
The ATO says online compassionate-release applications are normally assessed within 14 days.
Paper applications are normally assessed within 28 days.
That does not mean somebody can decide to enter rehab today and assume their Super will be available exactly 14 days later.
The medical evidence needs to be prepared first. Additional information may be requested. ATO processing can take longer in some circumstances. And once the application is approved, the Super fund still needs to process the release.

The ATO does not impose a general limit on the number of compassionate-release applications a person can submit.
